These Terms & Conditions apply to you, whether you are:

  1. A user of IT Service Nepal’s in-house products, or
  2. A client/customer whose products or services are designed, developed, or maintained by IT Service Nepal.

By accessing or using our products or services, you agree to these terms.

1. Services & Products

We provide:

  • Website and software development
  • Mobile and web applications
  • Digital products and platforms
  • Technical support, maintenance, and consulting

Features, pricing, and scope may vary per project or product.

2. Project Scope & Charges

Domain registration, hosting, SMS gateway, payment gateway, third-party tools, and licenses are not included unless agreed in writing.

Payment gateway integration charges (starting from):

  • Android App: NPR 45,000
  • iOS App: NPR 45,000
  • Web: NPR 35,000
    (Final cost depends on project complexity)

3. Payments

3.1 Project Fees

For projects valued above NPR 35,00,000:

  • 30% advance payment prior to project commencement
  • 40% payment during the development phase
  • 30% payment upon completion and prior to delivery or deployment

For projects valued below NPR 35,00,000:

  • 50% advance payment prior to project commencement
  • 50% payment upon completion and prior to delivery or deployment

3.2 Advance Payment

All advance payments are non-refundable, as they cover project planning, resource allocation, and project initiation costs.

3.3 Payment Clearance

All pending payments or installments must be fully cleared at the time of project delivery or before the project goes live, whichever occurs first.
The company reserves the right to withhold delivery, restrict access, or delay deployment until all outstanding payments have been received.

3.4 Taxes

All prices are exclusive of VAT or other applicable taxes, unless otherwise clearly stated in writing.

3.5 Support and Maintenance

Fees for Support and Maintenance services must be paid at the beginning of the agreed service tenure.
Support and maintenance services will only commence after the payment has been received in full.

3.6 Late Payment

If any payment is delayed beyond the agreed payment date, the company reserves the right to pause project work, delay delivery, or suspend services until the outstanding payment is settled.

3.7 Project Suspension

If payment delays exceed a reasonable period, the company may temporarily suspend the project or services without liability for timeline delays caused by such suspension.

3.8 Alternative Payment Arrangements

Any alternative payment schedule must be mutually agreed upon in writing by both parties.

4. Refund & Cancellation

  • No refunds for completed or partially completed services
  • Cancelling a project after work begins does not waive payment obligations
  • Subscription fees are non-refundable once charged
  • Cancelling a subscription stops future billing, does not refund the current period
  • In-app purchase refunds are governed by Google Play / Apple App Store

5. Subscription Terms

  • Monthly, yearly, or one-time subscriptions
  • Auto-renew unless cancelled before renewal
  • Manage via Google Play, Apple ID, or web dashboard
  • Non-transferable

6. Maintenance & Support

  • Static websites: No cost if no changes
  • Content-based dynamic websites: 15% of project cost (minimum NPR 15,000) — bug fixes & technical support
  • Web/mobile applications: 35% yearly maintenance
  • Major changes or new features billed separately

7. User/Client Responsibilities

You must:

  • Provide accurate content and materials
  • Ensure legal ownership of submitted materials
  • Review and approve work in a timely manner

Delays do not suspend payment obligations.

8. Intellectual Property

  • Ownership of custom work transfers only after full payment
  • IT Service Nepal retains internal tools/frameworks
  • May showcase work in portfolio unless restricted

9. Product Usage Rules

You must not:

  • Attempt unauthorized access
  • Reverse engineer or misuse systems
  • Use services for illegal or harmful activities

Violations may result in suspension or termination without refund.

10. Limitation of Liability

We are not liable for:

  • Data loss from hosting or third parties
  • Business, revenue, or indirect losses
  • Issues arising from content you provide
  • Downtime beyond reasonable control

11. Termination

We may suspend or terminate your access for:

  • Non-payment
  • Violations of these Terms
  • Misuse or abuse of systems

12. Updates to Terms

  • We may update these Terms & Conditions at any time
  • Continued use constitutes acceptance

13. Governing Law

These Terms & Conditions are governed by the laws of Nepal

14. Applicability

These Privacy Policy and Terms & Conditions apply to all users of IT Service Nepal’s in-house products and all clients/customers whose products or services are designed or developed by IT Service Nepal. They describe your rights and responsibilities when using our products or services.
